1. Overview

thecolorpalette is a web-based and Chrome extension tool offered by Devpages by Devrim Kaymaz. It allows users to create, manage, and export color palettes, gradients, and other design assets, with optional AI-powered features and Pro exports.

2. User Rights & Content

You retain full ownership of any palettes, gradients, or content you create using thecolorpalette.

You are free to use your creations for personal and commercial purposes without attribution.

All non-user content (UI, code, structure, assets) remains the intellectual property of thecolorpalette.

3. Accounts & Access

Accounts are optional and created via email Magic Link.

Some features (e.g., Pro exports, AI tools) require a paid subscription.

The free plan offers unlimited usage except for:

• AI generation: limited to 10 requests/hour
• Figma export, animated gradient export (SVG), and certain Pro tools.

4. Pro Subscription & Payments

Paid features are accessible via a monthly subscription managed entirely through Stripe.

Users can manage or cancel their subscriptions via the Stripe billing portal.

No refunds are granted by default, but refund requests may be reviewed manually.

If payment fails or is canceled, access to Pro features is revoked automatically.

5. Prohibited Use

You agree not to:

• Create or share offensive, hateful, or discriminatory content.
• Attempt to scrape, copy, or reverse engineer any part of the Service.
• Abuse the AI export functionality (e.g., excessive or automated use).
• Use bots or scripts to automate interaction with the platform.

Violation may result in account termination without prior notice.

6. Limitation of Liability

We are not liable for:

• Errors in AI-generated content or exported files.
• Server downtimes, bugs, or technical interruptions.
• Any damages resulting from the use or inability to use the platform.

All services are provided "as is", without any warranty, express or implied, including merchantability or fitness for a particular purpose.

7. Governing Law & Jurisdiction

These Terms are governed by Swiss law.
Any disputes shall be subject to the exclusive jurisdiction of the Tribunal de commerce du canton de Fribourg (Switzerland).

8. Modifications to the Terms

We may update these Terms occasionally. Continued use of the Service after changes constitutes your acceptance of the updated Terms.
